Abstrak

Kegiatan dalam bentuk pengaduan dari korban yang merasa dicemarkan nama baiknya oleh orang lain semakin meningkat dan terjadi di semua tingkat kepolisian di Indonesia. Setiap orang dapat merasa tersinggung dengan penghinaan yang berbeda-beda, sehingga penegakan hukum tindak pidana berdasarkan Pasal 310 ayat (3) KUHP memerlukan objektivitas terhadap tuduhan penghinaan. Pasal ini bertujuan untuk mengesahkan objektivitas tuduhan korban atas dugaan penghinaan dan penghinaan. Wujud konkret dari kepentingan umum dan ketidakberpihakan tuduhan korban. Hasil diskusi memvalidasi bahwa dasar pengajuan pengaduan korban memerlukan bukti akibat dari dugaan penghinaan berupa kerugian akibat rasa malu. Parameter kedua adalah makna kepentingan umum yang mendasari penghapusan sifat delik yang berlandaskan keadilan dengan mewujudkannya dalam situasi konkret, yaitu dalam mengalokasikan kepentingan masyarakat berupa kerugian masyarakat
